SMS Consent & Terms

This page describes how DishPatch collects customer consent to send SMS payment links, and the full terms of our text messaging program. This page is provided as opt-in documentation for regulatory and carrier compliance.

Customer Calls the Restaurant

A customer calls a restaurant that uses the DishPatch AI phone ordering system. The call is answered by the DishPatch AI voice agent. All calls are recorded and retained.

AI Agent Takes the Order

The AI host greets the customer, takes their full food order, and confirms items, quantities, and any dietary modifications.

Express Verbal Consent Requested

Before any SMS is sent, the AI agent explicitly asks the customer for consent using language such as:

"To complete your order, we'd like to send you a secure payment link by text message to the number you're calling from. Standard message and data rates may apply, and you can reply STOP at any time to opt out. Do you consent to receive this text message?"

Customer Verbally Agrees (or Declines)

If the customer says "yes" or otherwise affirmatively agrees, consent is recorded and a Stripe payment link is sent to their number. If the customer says "no" or does not consent, no SMS is sent and the restaurant is notified to arrange an alternative payment method. Consent is never assumed.

Consent Recorded & Retained

The phone call recording serves as the record of consent. Call recordings are retained for a minimum of 4 years in compliance with TCPA recordkeeping standards. Each recording is timestamped and linked to the specific order and phone number.

SMS Messages Sent

Once consent is given, the customer may receive up to 4 transactional SMS messages related to their order:

Payment Link: "Your order at [Restaurant Name] is ready for payment. Pay securely here: [Stripe link]. Reply STOP to opt out. Msg & data rates may apply."

Payment Reminder (5 min): "Reminder: Your payment link for your order at [Restaurant Name] expires soon. Complete payment here: [Stripe link]. Reply STOP to opt out."

Order Ready: "Great news! Your order at [Restaurant Name] is ready for pickup. See you soon!"

Pickup Reminder (15 min): "Reminder: Your order at [Restaurant Name] is still waiting for pickup. Please come in at your earliest convenience."

No consent, no message. DishPatch's system is designed so that no SMS is ever sent without an affirmative verbal response from the customer during the recorded call. Silence, ambiguous responses, or any non-affirmative answer result in no SMS being sent.

Purpose
To send customers a one-time Stripe payment link after they place a food order via phone and provide verbal consent to receive an SMS.
Opt-In Method
Express verbal consent collected during a recorded inbound phone call to a DishPatch-powered restaurant. The customer must affirmatively say "yes" or clearly agree when asked by the AI agent. This page (dishpatch.io/sms-consent.html) is provided as supporting opt-in documentation.
Message Content
Transactional only. Messages may include: (1) a secure Stripe payment link for the customer's order, (2) a payment reminder if the link has not been completed within 5 minutes, (3) an order ready notification when the kitchen has completed the order, and (4) a pickup reminder if the order has not been collected within 15 minutes. No marketing or promotional content is included in any message.
Message Frequency
Up to 4 messages per order:

(1) Payment Link — sent immediately after the customer verbally consents during the call.
(2) Payment Reminder — sent once if the Stripe payment link has not been completed within 5 minutes.
(3) Order Ready — sent when the kitchen marks the order as prepared and ready for pickup.
(4) Pickup Reminder — sent once if the order has not been picked up within 15 minutes of being marked ready.

Not all messages will be sent for every order. Message frequency depends on customer action and order status. Message frequency may vary.
Message & Data Rates
Standard message and data rates may apply. DishPatch is not responsible for charges from your mobile carrier.
Opt-Out
Reply STOP to any message to unsubscribe. You will receive one confirmation message and no further SMS will be sent to your number. To re-subscribe, reply START.

Supported Carriers
All major US carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carrier is not liable for delayed or undelivered messages.
Privacy
Your mobile number is used solely to send the payment link for your specific order. It is not shared with third parties for marketing purposes. See our full Privacy Policy.
Consent Records
All consent is documented via call recording retained for a minimum of 4 years per TCPA requirements.
